Article 1 - Definitions

In these terms and conditions, the following definitions apply:

Withdrawal period: the period within which the consumer can exercise their right of withdrawal;

Consumer: the natural person who does not act in the exercise of a profession or business and enters into a distance contract with the entrepreneur;

Day: calendar day;

Extended transaction: a distance contract concerning a series of products and/or services, the delivery and/or purchase obligations of which are spread over time;

Durable medium: any means that allows the consumer or entrepreneur to store information addressed personally to them in a manner enabling future consultation and unaltered reproduction of the stored information;

Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the withdrawal period;

Entrepreneur: natural or legal person offering products and/or services to consumers at a distance;

Distance contract: a contract concluded within the framework of a system organized by the entrepreneur for the distance selling of products and/or services, whereby exclusive use is made of one or more techniques for distance communication up to and including the conclusion of the contract;

Technique for distance communication: means that can be used to conclude a contract without the consumer and entrepreneur being together in the same room at the same time;

General Terms and Conditions: the current general conditions of the entrepreneur.

Article 3 - Applicability

These general terms and conditions apply to every offer made by the entrepreneur and every distance contract and order concluded between the entrepreneur and consumer.

Before the distance contract is concluded, the text of these general conditions shall be made available to the consumer. If this is not reasonably possible, it shall be indicated that the general conditions can be viewed at the entrepreneur’s premises, and they will be sent free of charge to the consumer upon request.

If the distance contract is concluded electronically, contrary to the previous paragraph and before the distance contract is concluded, the text of these general conditions may be made available electronically to the consumer in such a way that it can be easily stored by the consumer on a durable medium. If this is not reasonably possible, it shall be indicated where the general conditions can be reviewed electronically and that they will be sent electronically or otherwise free of charge at the consumer's request.

If specific product or service conditions apply in addition to these general conditions, the second and third paragraphs apply correspondingly, and in the event of conflicting general conditions, the consumer may always rely on the provision most favorable to them.

If one or more provisions in these general conditions at any time are wholly or partially invalid or annulled, the contract and these conditions will otherwise remain in effect, and the relevant provision will promptly be replaced by mutual agreement with a provision that corresponds as closely as possible to the intention of the original.

Situations not covered by these general conditions shall be assessed "in the spirit" of these general conditions.

Uncertainties about interpretation or content of one or more provisions of our general conditions shall be interpreted "in the spirit" of these general conditions.

 

Article 4 - The Offer

If an offer has a limited validity or is subject to conditions, this shall be explicitly stated in the offer.

The offer is non-binding. The entrepreneur is entitled to change and adapt the offer.

The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to enable the consumer to make a proper assessment. If the entrepreneur uses images, these represent the products and/or services offered truthfully. Obvious mistakes or errors in the offer do not bind the entrepreneur.

All images, specifications, and data in the offer are indicative and cannot give rise to compensation or termination of the contract.

Images accompanying products truthfully represent the products offered. The entrepreneur cannot guarantee that the displayed colors exactly match the real colors of the products.

Each offer contains such information that it is clear to the consumer what rights and obligations are attached to accepting the offer, particularly:

● The price, excluding customs clearance costs and import VAT. These extra costs are at the customer's expense and risk. The postal/courier service applies special arrangements for imports.

● Any shipping costs;

● How the contract will be concluded and necessary actions;

● Whether the right of withdrawal applies;

● Method of payment, delivery, and implementation of the contract;

● The acceptance period or period during which the entrepreneur guarantees the price;

● The charge for distance communication if calculated on a basis other than the standard rate;

● Whether the contract is archived after conclusion and how the consumer can access it;

● How the consumer can check and correct data provided before concluding the contract;

● Other languages available for concluding the contract besides Dutch;

● Conduct codes adhered to by the entrepreneur and how the consumer can access them electronically;

● Minimum duration of distance contract for extended transactions.

Optional: Available sizes, colors, and materials.

 

Article 5 - The Contract

Subject to Article 4, the contract is concluded when the consumer accepts the offer and fulfills conditions set out.

If accepted electronically, the entrepreneur immediately confirms receipt of acceptance electronically. If not confirmed, the consumer may terminate the contract.

For electronic contracts, the entrepreneur ensures data security and a secure web environment. Secure electronic payment measures are also implemented.

Within legal frameworks, the entrepreneur may investigate consumer payment capacity. The entrepreneur may refuse an order or impose conditions based on this investigation.

The entrepreneur will include the following information:

● Visiting address for complaints;

● Conditions and manner of exercising withdrawal rights;

● Warranty information and customer service;

● Information stated in Article 4.3, unless previously provided;

● Termination conditions for contracts longer than one year or indefinite duration.

Each contract is subject to sufficient product availability.

 

Article 6 - Right of Withdrawal

Consumers have 30 days to withdraw without reason, starting from receipt of products. Products must be handled carefully and returned complete, if possible, in original packaging.

Withdrawal must be communicated within 30 days and products returned within another 14 days. Timely return proof is required.

Non-action within specified periods finalizes the purchase.

 

Article 7 - Costs of Withdrawal

Return shipping costs are borne by the consumer. Refunds are processed within 14 days upon receiving returned products.

 

Article 8 - Exclusion of Withdrawal

Withdrawal can be excluded for clearly indicated products, such as customized items, perishable goods, hygiene products, sealed recordings or software.

 

Article 9 - Price

Prices are not increased during offer validity except due to VAT changes or uncontrollable financial market fluctuations.

 

Article 10 - Conformity and Warranty

The entrepreneur guarantees products/services comply with contract specifications and applicable regulations. The warranty period matches the manufacturer's warranty.

Warranty exclusions apply in cases of consumer modification, improper use, or government-imposed quality changes.

 

Article 11 - Delivery and Implementation

Products are delivered to the consumer's specified address within 30 days unless otherwise agreed. Delays permit consumer termination and refunds within 14 days.

The entrepreneur bears product loss/damage risk until delivery.

 

Article 12 - Extended Transactions

Termination and renewal conditions apply clearly, including specific termination rights and notice periods for ongoing transactions.

 

Article 13 - Payment

Payments must be made within 7 working days after the withdrawal period commences. Consumers must report payment inaccuracies promptly.

 

Article 14 - Complaints Procedure

Complaints must be submitted clearly within 7 days of noticing issues. Responses occur within 14 days.

 

Article 15 - Disputes

Contracts are governed by UK law, even if consumers reside abroad.

 

Article 16 - CESOP

From 2024, payment providers may record data in the CESOP system per relevant regulations.
